Broadcast TV networks, Dish Network file lawsuits over new Auto Hop ad skipping feature

Dish Network shocked us just a couple of weeks ago by upgrading its new Hopper DVRs with "Auto Hop" ad skipping that targeted prime time programming on broadcast TV captured via its PrimeTime Anytime feature, and predictably, the networks aren't happy. After several executives took shots at the service during upfronts for the new fall programming in the past few weeks, Fox has filed suit in US District Court, while Dish Network responded with its own request for a court order specifying that it does not infringe on the TV network's copyrights. Just in the last few minutes, the New York Times reports NBC has filed a lawsuit against Dish Network as well, and it likely won't be the last one to do so. ReplayTV folded under similar legal pressure, but clearly Dish Network thinks it has a workable solution and now it's going to be up to the courts to decide who wins.

The main barriers to hearing aid use are being addressed by experts in Nottingham as part of an innovative research project.

Hearing aids have the potential to transform the lives of those with permanent hearing loss, yet out of the three million people who have one, around 25 per cent 750,000 people choose not to wear their device.

Now researchers are offering easy-to-use, interactive video tutorials offering handy tips and advice in a bid to increase the chances of success for people using their hearing aids for the first time and make the most of their device.

If they are successful, the tutorials could be routinely given to patients receiving hearing aids on the NHS within the next three years.

The project and is being led by the National Institute for Health Research (NIHR) National Biomedical Research Unit in Hearing (NBRUH) and brings together expertise from researchers and leading clinicians from The University of Nottingham and Nottingham University Hospitals NHS Trust.

Consultant clinical scientist Mel Ferguson, from Nottingham University Hospitals NHS Trust, who is leading the study, said: "A huge amount of information is given to patients verbally when they receive their hearing aids, yet much of it is forgotten a few weeks later. Many problems that occur could be easily solved if only the patient knew what to do and often hearing aids end up in the proverbial 'kitchen drawer'."

In addition to issues with retaining the large amount of information given to users at their clinic appointment, there are other significant barriers to hearing aid use before patients even reach the referral stage.

Many hearing aid users have had difficulties in hearing for at least 10 years before they get a hearing aid citing many reasons for not seeking advice. These include perceiving their hearing to be 'not that bad', acceptance of hearing loss as a normal consequence of ageing, lack of awareness of that they may have a hearing loss ('everyone mumbles these days'), lack of understanding of hearing loss and what to do about it, and simply avoiding to address the issue.

In addition, many people who need a hearing aid are not given the referral they need to see a specialist. Just under half (47 per cent) of those with a significant hearing loss in the 55-74 year age group who went to their GP with complaints of hearing loss failed to get an onward referral to audiology services.

The project team has worked with more than 30 hearing aid users to develop eight video tutorials that can be played on a DVD player, computer or via the internet, which provide advice on how best to use hearing aids and communicate with family and friends.

The tutorials reinforce information and advice given at the clinic appointment and include information, animations, videos and powerful messages from users of hearing aids about their personal experiences.

At the end of each tutorial there is an interactive quiz so the patients can review what they have learned. The tutorials, which total an hour in duration, will also offer friends and family an important insight into how best to support the hearing aid user by developing a better awareness of how best to hold conversations with people with hearing loss.

Anne Darby, an experienced hearing aid user of 30 years, played a key role in providing a patient perspective for the project. She said: "This is a fabulous resource for people receiving their hearing aids for the first time. It explains the mechanics of hearing and how hearing aids work, supports people through the difficulties of adjustment, lets the viewer know that they are not alone, points to other resources and, most of all, is reassuring to the patient and their partners, family and friends."

The team has received a 235,000 NIHR Research for Patient Benefit grant and is now in the process of evaluating the potential benefits of the tutorials. Involving 200 patients, it is expected to find substantial success in terms of better hearing aid use and improved communication with family and friends.

The first hearing aid patient to complete the trial, Hazel Hampton said she was delighted with the tutorials, adding: "If I did not have the DVD I might have given up wearing my hearing aids. Because of the DVD I have entered a much easier self-directing and informative environment, instead of a wild woolly and noisy world. I think the DVD is a well thought out educational resource.'

Dr Gareth Smith, President of the British Academy of Audiology, said: "In the new NHS arena, where evidence-based, clinical innovation is the key to successful service delivery and outcomes for patients, NBRUH are in a fantastic position to spearhead positive change. This award-winning project, simple in design yet so effective in practice, sets the bar for other healthcare professionals to consider how they can follow this example to improve patient out-comes. The challenge has now been set for the audiology profession to incorporate this model of information delivery into everyday practice."

SpaceX rocket launch hailed as 'a new era in space exploration'

In a pivotal moment for private spaceflight, a towering white rocket lifted into space a cone-shaped capsule headed for a three-day trip carrying cargo to the International Space Station and a tricky rendezvous in outer space this week.

The launch Tuesday marked the first time a private company has sent a spacecraft to the space station. On a column of fire, a Falcon 9 rocket ? built by Space Exploration Technologies Corp., or SpaceX ? carried the unmanned Dragon capsule into space after a 3:44 a.m. EDT launch from Cape Canaveral, Fla.

But the launch is just the beginning of the mission, and some of the most challenging tasks lie ahead.

The Dragon capsule is on its way to rendezvous with the space station as it circles the Earth at about 17,000 mph. Once the Dragon catches up to the station, the next big step will take place Thursday, when Dragon's sensors and flight systems will be given a series of complicated tests to determine whether the vehicle is ready to berth with the space station.

These tests include delicate maneuvers to guide the vehicle to within 1.5 miles of the station. If all goes well, the crew aboard the station will try to grab the spacecraft Friday with a robotic arm and pull it in.

"We obviously have to go through a number of steps to berth with the space station, but everything is looking really good, and I think I would count today as a success no matter what happens with the rest of the mission," Elon Musk, SpaceX's 40-year-old billionaire founder and chief executive, said at a predawn news conference after the launch.

Musk spoke at company headquarters in Hawthorne. It was there that SpaceX employees had gathered, watched and cheered as the Falcon 9 climbed toward the heavens. The Dragon's roughly two-week mission will be completed when it splashes down in the Pacific hundreds of miles off Southern California. The craft will deploy parachutes to slow its descent after entering Earth's atmosphere.

"Everything that SpaceX is doing in orbit from now on is new for a private company and really pushing the envelope," said Alexander Saltman, executive director of the private space trade group Commercial Spaceflight Federation. "Because the mission is so difficult, it's quite possible that they won't accomplish all their goals. But even if they don't get everything this time, they'll be sure to try again next time around."

SpaceX's mission is considered the first test of NASA's plan to outsource space missions to private companies now that its fleet of space shuttles is retired. SpaceX aims to prove to NASA that its Falcon 9 rocket and Dragon capsule are ready to take on the task of hauling cargo ? and eventually astronauts ? for the space agency.

"Today marks the beginning of a new era in exploration," said NASA Administrator Charles Bolden in a speech Tuesday at Cape Canaveral. "And while there is a lot of work ahead to successfully complete this mission, we are certainly off to good start."

After years of testing, the space agency is hoping to turn the job of carrying cargo and crews over to private industry at a lower cost. Meanwhile, the agency will focus on deep-space missions to land probes on asteroids and Mars.

The agency has poured nearly $400 million in seed money into SpaceX in hopes that the company can one day complete routine missions to the space station. NASA now is paying $63 million to the Russians each time it wants to send an astronaut to the station.

Critics, including some former astronauts, have voiced concerns about NASA's move toward private space missions. They said that private space companies are risky ventures with unproven technology.

SpaceX is one of the leading contenders to carry astronauts for NASA one day. Company officials say cargo missions will yield valuable flight experience toward accomplishing this goal by 2015.

Still, the company has experienced repeated delays over the years. For instance, SpaceX planned to launch the current mission Saturday. The countdown was flawless until the last second, when the rocket engines briefly fired up and then went dark.

SpaceX said a flight computer detected an anomaly in one of the rocket's nine engines and automatically shut down the launch sequence. Later that day, company engineers traced the problem to a faulty valve, and technicians fixed it within hours.

That made Tuesday's launch all the more exciting for Musk, who said that when he saw the Falcon 9 finally lift off, "every bit of adrenaline in my body released at that point."

Founded in 2002, SpaceX makes the Dragon and Falcon 9 at a sprawling facility in Hawthorne that once was used to assemble fuselage sections for Boeing 747s. The hardware is put on a big rig and trucked to Cape Canaveral for launches.

The company, with about 1,800 employees, has a $1.6-billion contract to haul cargo in 12 flights to the space station for NASA. If the current mission is successful, SpaceX will begin fulfilling the contract this year.

Congratulations flowed in to SpaceX from Twitter users all over the world, including members of Congress, executives at Virgin America and even the Republican Party of Florida.

"We're at the dawn of a new era in space exploration," Musk said. "There are no precedents for what we're doing here."

Tunisia sets terms for extradition of ex-Libyan PM

(AP) ? Libya's former prime minister will only be extradited to his country if his life isn't in danger there and he can be guaranteed a fair trial, Tunisia's presidential spokesman said Wednesday.

The statement to the state news agency tempers Tuesday's surprise announcement that former Libyan leader Moammar Gadhafi's last prime minister, Al-Baghdadi Al-Mahmoudi, would be sent back to Libya to stand trial, despite the reservations of human rights organizations.

Al-Mahmoudi was arrested in September for illegally crossing the frontier into Tunisia as he tried to flee to Algeria, where members of Gadhafi's family had sought refuge.

"Tunisia will not extradite Al-Baghdadi Al-Mahmoudi ... unless Libya can provide guarantees of a fair trial," said presidential spokesman Adnan Mancer. "Tunisia will not send back Al-Mahmoudi if it believes there is a danger to his life."

Mancer said the accord agreed upon by the two countries to extradite Al-Mahmoudi will involve the creation of a Tunisian commission to verify the functioning of the Libyan justice system and the safety of the former prime minister ? procedures that may take some time.

On Tuesday, a spokesman for Tunisia's Justice Ministry said it would be a matter of weeks.

Al-Mahmoudi's lawyer, Bechir Essid , has denounced the decision as "unjust and against Tunisian law." He added that for the past few days, Al-Mahmoudi has been on a hunger strike after eight months of imprisonment.

Libya has been clamoring for the repatriation of Al-Mahmoudi to answer for crimes it says he committed during Gadhafi's regime.

Officials from the former regime have not fared well in the hands of the Libyan rebels, with Gadhafi and one of his sons being executed upon capture last year.

In January, 15 Tunisian and international human rights groups, including Amnesty International and Human Rights Watch, signed a statement opposing Al-Mahmoudi's extradition, saying he risked death or torture if he was returned to Libya.

Greens' concern for energy bill

Environmentalists now fear that the UK government's draft energy bill to be published on Tuesday will end in a new "dash for gas".

They want the bill to be guided by the government's stated wish to almost completely de-carbonise the electricity industry by the 2030s.

But there has been no guarantee such a target will be enshrined in the bill.

The environmentalists say ministers' problems with new nuclear power will leave the UK gas-dependent for decades.

The UK could buy emissions permits on the European market to keep to its medium-term emissions reductions targets.

But a failure to de-carbonise electricity would divert the Britain from its course to cut CO2 by 80% by 2050 - unless the gas-fired power stations were made to run with carbon capture and storage, a technology that is unproven on a large scale.

Up front

Tuesday's document has been awaited since last year. The Electricity Market Reform (EMR) it proposes was designed to bring a greater element of planning into the energy market to guarantee a clean mix of electricity supplies - particularly nuclear power.

The government will introduce long-term price contracts to provide reassurance for investors in nuclear and offshore wind farms, which need huge up-front expenditure but then run relatively cheaply when they are built.

At the moment, it is illegal for an EU state to subsidise nuclear power and the EMR contracts are seen as a way round that.

The long-term contracts are likely to be negotiated in the first place on a scheme-by-scheme basis, probably between the generators and the National Grid. In later phases, firms will bid for contracts in auctions.

The extra cost of guaranteeing clean power will come from a levy on people's bills, although it is not clear yet how large the Treasury will allow that levy to be.

As the fine technical details have been worked out, the government's over-arching energy plans have been blown off course by the failure to strike a deal with the nuclear power generators who, according to the Committee on Climate Change, should provide 40% of our electricity by 2030.

Nuclear option

Ministers are determined to have some nuclear new-build, even though following the withdrawal of the generators E.oN and RWE, it will clearly be far fewer than the eight stations previously envisaged. Some observers think only one station will eventually get built.

With EDF left as the only significant bidder for nuclear, the Treasury has been caught in protracted wrangling over the nuclear price - a process that is said to be dragging back the legislation. The legislative uncertainty, meanwhile, is deterring investors in renewables.

Tuesday's draft bill is not expected to contain details of the proposed long-term contracts.

"It's a shambles," Greenpeace director John Sauven told BBC News. "The most important question is: 'What is the objective of this bill?'

"If your objective is to have a low- or zero-emission electricity sector, you need to have a strategy and that needs to be clearly stated. But the government isn't clear about it. The longer this disarray in policy lasts, the more likely it is that we get another dash for gas which will break all our CO2 targets.

"On the one hand, the government is saying: 'We have the Climate Change Act and the Green Investment Bank', but the thing that really matters is being clear about what you are doing on renewable energy - and they're not clear about that. Their climate policy is all mouth and no trousers."

Carbon capture

The UK's leading green groups have written to Energy Secretary Ed Davey, urging him to introduce a bill which commits that by 2030 electricity should be produced for less than 50g of CO2 per kWh; equal support for demand reduction as well as new generation; and support for renewables that is predictable and simple (many in the industry are dismayed by the extreme complexity of the proposed contracts system).

I understand, though, that a scheme planned to reduce energy demand by incentivising energy saving - so-called NegaWatts - has been left out of Tuesday's document. I am told that it was technically too difficult to agree a baseline from which industries would make their proposed energy savings.

Frustration at the government's delay over the bill is widespread but not all environmentalists think a dash for gas is the worst possible outcome.

Bryony Worthington, a Labour peer who runs a green pressure group Sandbag, told BBC News: "I am not as bothered as some others about a new dash for gas because we need to replace coal much more urgently than we are.

"The way out is for gas power stations to be built in a way so they can be retrofitted to take hydrogen or emissions captured and stored."

The Environment Agency's chairman, Chris Smith, recently gave a reluctant endorsement to shale gas in the UK with the key proviso that it was fitted with CCS.

China price pressure

I understand that the Committee on Climate Change is also sanguine about the inevitability that by 2030, gas may provide a large share of electricity on the grounds that nuclear is likely to under-deliver and offshore wind is still stubbornly expensive.

But whilst lobbyists have been urging the government to favour gas as a way of keeping prices affordable, the green groups point out that the big rises in gas bills are the overwhelming reason for high electricity bills.

They are not alone. Alistair Buchanan, chief executive of the regulator Ofgem, recently warned that the UK could face very high gas prices in future as China increasingly competed for gas on the world market.

To add to the confusion over energy policy - a state that has lasted nearly a decade - the government has also announced a consultation on the use of gas for electricity generation to run alongside its market reform legislation - even though critics say a decision on gas needs to come before any broader reform.

'Clarity required'

The draft bill is being introduced so the proposals can be scrutinised by parliament before appearing as a fully fledged bill in the Autumn.

The proposals will be put to the Energy and Climate Change Committee, whose chairman, Tim Yeo, told BBC News: "I fear there are going to be some very big holes in this draft bill.

"It really is vital that the government gives clarity to investors soon because tens of billions are needed, and renewables investors are being deterred by the ongoing uncertainty."

Mr Yeo said he favoured a more simple system of support for renewables and nuclear, and he re-iterated his call for the government to simply declare a subsidy for nuclear and then square it with Brussels.

He agreed that the draft bill should re-commit the government to its existing aspiration to de-carbonise electricity in the 2030s, although he also doubted that the promise would be delivered within the bill.

The 2030 plan was endorsed by the prime minister in November 2010 when the prospects for gas, nuclear and offshore wind power looked rather different from now.
